Key details in the investigation of the slaying of Broomfield teen Kelsey Shannon will remain sealed until at least April 22, the date of a preliminary hearing for her former boyfriend Alexander “Alex” Paul Pacheco.

Pacheco, 18, of Broomfield, was arrested Jan. 24 on suspicion of killing 13-year-old Kelsey, whose remains were found three days earlier alongside a drainage ditch in the Broadlands area of Broomfield. Kelsey, an eighth-grader at Westlake Middle School, had been missing since October.

Arrest affidavits and search warrants in the case have been sealed since Pacheco’s arrest. On Monday, District Court Judge John Popovich issued a written ruling stating they would stay that way.

Popovich had to weigh a request that the records be opened to the public versus defense and prosecution arguments that releasing the records would hamper further investigation, taint a potential jury pool and perhaps hinder prosecution.

The records would reveal what evidence led police to suspect Pacheco of killing Kelsey and what they found when they arrested him at a home in Lakewood.

In his ruling, Popovich wrote, “there is an ongoing and active investigation, and the subject affidavits contain hearsay or other information which may not be admissible at the time of trial, and therefore access to that information may taint a witness’ memory, perception and statements. …”

“The court finds and concludes that the defendant’s right to a fair trial and the people’s obligation to conduct a thorough investigation outweigh the asserted qualified First Amendment right.”

Popovich also noted that much of the information contained in the affidavits “will likely be disclosed in testimony and evidence presented at (the preliminary) hearing.”

The preliminary hearing is scheduled for 8:30 a.m. April 22 at the Broomfield courthouse. Pacheco is being held at Broomfield County Jail without bond.
