BOULDER, Colo. –

A Boulder man charged with breaking into homes, stealing women’s underwear and filming himself masturbating with the garments has requested a special prosecutor because he’s distantly related to the Boulder County district attorney.

According to court records, Wesley Francis Cox, 44, is the cousin of Boulder County District Attorney Stan Garnett’s brother-in-law, who lives in Portland, Oregon.

“Mr. Cox and District Attorney Garnett are related by marriage,” Cox’s defense attorney, Lawrence Mertes, wrote in a recent motion. “An ethical conflict would result from the prosecution of Mr. Cox by District Attorney Garnett, and/or his staff.”

A district court judge has since denied the motion without submitting a written opinion, officials said.

Mertes didn’t immediately return a phone call Friday, but Garnett strongly rejected the notion that he could be influenced in the case.

“I’ve lived in Boulder County for a long time, as has my family â and I come form a fairly large family â so from time to time I run across people with which there maybe some connection,” Garnett said. “I will make sure everybody in my office, and myself, withdraws from any case where it would be appropriate to do so.”

Garnett acknowledged the connection and said he attended his sister’s wedding in 1988, as did Cox. But he said he doesn’t remember the two ever meeting.

In a response motion, prosecutors wrote that Garnett, “stands to receive neither benefit nor detriment from the prosecution of (Cox).”

Garnett said both the U.S. Supreme Court and the Colorado Court of Appeals have ruled that cursory connections between prosecutors and defendants isn’t a valid reason for needing a special prosecutor.

Cox, who has been charged with six counts of unlawful sexual contact, four counts of second-degree burglary and six counts of first-degree trespassing, is scheduled to be arraigned on March 20. He continues to be held at the Boulder County Jail in lieu of a $50,000 bond.
