A 20-year-old man accused of raping a woman he met through an app in 2017 took a plea deal this week.

Jose Avina appeared in court for an arraignment before Boulder District Judge Andrew Hartman. He pleaded guilty Thursday to contributing to the delinquency of a minor, a Class 4 felony, according to the Boulder District Attorney’s Office spokesperson, Shannon Carbone .

Prosecutors dismissed two sex assault charges as a condition of the plea.

According to an arrest affidavit, a woman contacted police and a victims advocacy group to report she had been sexually assaulted in Boulder in 2017.

The woman said she and Avina met in August 2017 through a phone app. While she told him she wanted to pursue a romantic relationship, she said she was a virgin and was not ready to be intimate with him, according to the affidavit.

Avina, then 18, picked her up in the fall of 2017 and they drove to the Foothills Community Park, 800 Cherry Ave. They went to the backseat to kiss, but she told Avina she did not want to have sex, the affidavit said.

The woman reported to police that Avina then sexually assaulted her in the back seat of the vehicle. When her family members began walking near the car, calling her phone and looking for her, Avina stopped the assault, according to the affidavit.

Her family reported to police they thought “something may have happened,” however, the victim said at the time she denied the incident, because she didn’t want her relatives to know she was seeing Avina, the affidavit said.

When contacted by Boulder police, Avina confirmed going out with the woman and that they had gone to the back seat of the vehicle. He claimed that at first, the woman said she was “not sure” about sex but later said, “sure, if you want to.”

Avina did admit, however, the woman said to stop a few times while they were having sex, according to the affidavit. When asked why he did not stop when asked, he also reportedly told officers, “What girl is really going to want to stop in the middle of sex?”

At the time of his arrest in 2018, Avina was living in Chicago.

Avina is out of jail on bond, according to Boulder County Jail records. He is expected to be sentenced March 27, according to court records.
